RULES, CHARGES AND ACCESSORIAL SERVICES
FREEZABLE PROTECTIVE SERVICE

DESCRIPTION - Service consists of specific loading and transit processes
used to better protect shipments vulnerable to freezing during the winter
months.
Designed to protect shipments that freeze at 32 degrees Fahrenheit,
0 degrees Celsius and below.
Approved products include chemicals and allied products, canned, box
and bottled food and beverages (including alcohol), cosmetics,
pharmaceuticals and agricultural products such as root stock, flower
bulbs and seeds.
When Freezable Protection Service is requested on mixed shipments of
perishable and non-perishable articles, the weight of all articles in
the shipment will be considered as requiring protection and will be so
rated.
Designation of the Freezable Protective Service can only be applied to
outbound shipments.
Freezable Protective Service can only be engaged by Approved Freeze
Protection Shippers.
NOTATION - Commodities which require protection from freezing at 32
degrees Fahrenheit, 0 degrees Celsius and below because of their
perishable nature will be provided such protection at the rates and
charges contained in pricing agreements or customer contracts governed by
this publication, subject to the availability of suitable equipment and
provided the shipper states on the Bill of Lading, "PROTECT FROM
FREEZING".
To ensure the most careful handling of shipments vulnerable to freezing,
it is highly recommended that the freight itself be clearly marked with
the words "PROTECT FROM FREEZING" in addition to the notation on the bill
of lading.
ENGAGEMENT: To engage the Freezable Protective Service, shipper must
request protection from freezing on the Bill of Lading at the time of
shipment.
EXAMPLE: "PROTECT FROM FREEZING." On the original bill of lading at
the time of the shipment.
LIABILITY -
In the event Carrier receives a "PROTECT FROM FREEZING" request on a
Bill of Lading or inadvertently picks up a "PROTECT FROM FREEZING"
shipment from a Non-Approved Freeze Protection Shipper; Carrier will
move the shipment without engaging Freezable Protective Service and
limit the shipment liability to $1.00 per pound per package.
Carrier liability, for Approved Freeze Protection Shippers, is defined
in Items 780 - 782 of Tariff 100, or otherwise applicable provision.
Shipments having Excess Liability are not eligible for Freezable
Protection Service.
Carrier will have no liability for damage resulting from Shipper's
failure to properly engage Freezable Protection Service.
Invoicing records or any other written or oral communications shall not
be evidence of properly engaging this service.
Carrier will have NO liability if it inadvertently accepts a shipment with
a freezing point above 32 degrees Fahrenheit / 0 degrees Celsius even if a
specific freezing point, "PROTECT FROM FREEZING," and/or other instruction
is notated on the bill of lading indicating a higher freeze point.
Carrier will not be responsible for any damage to shipments, (I) if
said damage is the result of a delay in delivery because of the need
for delivery appointment, notification prior to delivery or any other
delay not attributable to the negligence on the part of the Carrier,
(II) if the shipment is refused by the consignee, or (III) if Shipper
insists on a pick up and/or delivery contrary to the specified pick up
and delivery dates.
Carrier reserves the right to suspend Freezable Protection Service if
the temperature is 10 degrees Fahrenheit or lower or if there is a
prolonged period of extreme cold weather.
Freezable Protection is not available on the following shipment
types:
COD - When the carrier is requested to collect a COD amount.
Consignee Drop - When the carrier spots or drops trailer or vehicle
at the Consignee's facility so the receiver may unload the trailers
or vehicles at its convenience.
Excess Liability - For shipments requiring Excess Liability.
Corrugated Dunnage - For shipments when corrugated dunnage is not
used under a shipment which is loaded on a pallet. If corrugated
dunnage is not used under the shipment, YRC may pick up the
shipment, but will not accept responsibility for a shipment if it
freezes.
Food Warehouse - For shipments delivered to a Food Warehouse.
In Bond - For shipments moving In Bond
Notation - For shipments with no notation on the Bill of Lading at
the time of shipment.
Order Notify - For shipments subject to Order Notify.
Trade Show - For shipments destined for a Trade Show.
Shipper Spot - When the carrier spots or drops trailer or vehicle at
the Shipper's loading facility so the Shipper may load the trailers
or vehicles at its convenience.
Non-Approved Freeze Protection Shippers - Shipments picked up from
non-approved shippers or shipping locations will not be able to
engage Freezable Protective Service.
ELIGIBILITY - Eligibility restrictions are as follows:
Freezable Protective Service is subject to the availability of suitable
equipment
Normal transit apply, but shipments might be held in transit to protect
against extended exposure to freezing temperatures because of road
closures, weekends, holidays or other delays.
Freezable Protective Service is extended to all points served direct in
the continental United States, Canada and Mexico.
In order to engage Freezable Protective Service the shipper of the
freight must be an Approved Freeze Protection Shipper.
DATES OF SERVICE - Freezable Protective Service shall be offered
November 1st through April 30th. Dates may be adjusted if weather
conditions dictate.
