When you register for New Penn, we ask for your name, email address, mailing address, phone number, company and title.
Please note that data protection laws in the United States differ from those in Canada. By providing us your personal information, you consent to the collection, transfer and processing of your personal information to and from both the United States and Canada and agree that your personal information may be subject to access requests from governments, courts or law enforcement in the United States according to the laws of the United States.

How To Submit a Request to Know or a Request to Delete

- Completing a CCPA Consumer Request Form through your New Penn account
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. To designate an authorized agent, email us at privacy@myyellow.com and we will provide you with a form to make a designated agent request.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. To make a request, you must:
If you have a New Penn account:
- Log into your New Penn account and use our authentication process to verify your identity.
- Complete and submit the CCPA Consumer Request (if a form is not yet available when you log in, email us and we will provide you with a form).
- Describe your request with sufficient detail that allows us to understand, evaluate and respond to it.
If you login as a guest:
- Call or email us to receive a CCPA Consumer Request Form
- Complete the CCPA Consumer Request Form
- Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or that you are an authorized representative
- If you request the categories of information we collect, we require your first and last name and your email address.
- If you request the specific information or to have your information deleted, we require your first and last name, email address and the PRO Number, Bill of Lading Number, or Invoice Number from three recent New Penn shipments.
- Describe your request with sufficient detail that allows us to understand, evaluate and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We will try to respond to your request within forty-five (45) days of when we receive it. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
An amendment to the CCPA provides an exemption to the Right to Know and Right to Delete for personal information between a business and a person who is acting as an employee, director, officer, or contractor of a company, partnership, sole proprietorship, nonprofit, or government where the information is used in the context of a business transaction. This exemption is currently set to expire on January 1, 2021. Until that date, we will not respond to requests to know or delete that meet this exemption.
How To Submit an Opt-Out Request
We do not and will not sell your personal information to third parties. If we change that practice in the future, we will update our privacy policy and provide an opt-out link pursuant to the CCPA. We will treat any information that we collected prior to such a change as though you opted-out of the sale of your personal information.

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
Your Nevada Privacy Rights
Nevada law (SB 220), permits customers in Nevada to opt-out of the sale of certain kinds of personal information. A sale under Nevada law is the transfer of this personal information to third parties for monetary consideration so these third parties can then re-sell or license the sold information. We do not sell your personal information to third parties as defined in Nevada law. If you are a Nevada resident and wish to opt-out of the sale of your personal information should we change our practices in the future, you must send a request by email to privacy@myyellow.com.
